Auction Terms & Conditions
Effective Date: April 10, 2026
Welcome to the online auction platform for Ray’s Body Shop & Wrecker Service. By registering, bidding, placing a bid, purchasing a vehicle, or otherwise participating in any auction, you agree to be bound by these Terms & Conditions.
1. General Auction Terms
All vehicles are offered for sale through a public and/or online auction process in accordance with applicable North Carolina law governing towing, storage, abandoned vehicles, unclaimed vehicles, and lien sales. Ray’s Body Shop & Wrecker Service (“Ray’s”) reserves the right, at its sole discretion, to:
- refuse, suspend, or revoke bidding privileges;
- remove, add, relist, or reoffer vehicles at any time, with or without notice;
- reject any bid;
- set, change, or enforce minimum bids or reserve prices; and
- cancel, postpone, or extend any auction in the event of clerical error, dispute, system issue, legal concern, or other business necessity.
2. Compliance with North Carolina Law
Vehicles are processed for sale in accordance with applicable North Carolina law, including procedures relating to abandoned vehicles, unclaimed vehicles, towing and storage liens, possessory liens, mechanic’s liens, and related title-transfer procedures administered through the North Carolina Division of Motor Vehicles (“NCDMV”). Applicable procedures may include, when required:
- notice to owners and lienholders;
- required waiting periods before sale;
- filing and processing of applicable NCDMV forms and notices; and
- compliance with any required disposition, title, or recordkeeping procedures.
Ray’s does not represent that every vehicle follows the same process, and the documentation available for each vehicle may differ depending on the facts of that vehicle and the procedure authorized under North Carolina law.
3. Vehicle Condition — AS-IS, WHERE-IS
ALL VEHICLES ARE SOLD AS-IS, WHERE-IS, WITH ALL FAULTS, AND WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
Without limiting the foregoing, Ray’s makes no warranty or representation regarding:
- condition or roadworthiness;
- safety or merchantability;
- fitness for a particular purpose;
- mileage or odometer accuracy;
- operability or mechanical condition;
- title status or title eligibility;
- emissions or inspection compliance; or
- completeness, authenticity, or accuracy of keys, parts, accessories, options, photos, or descriptions.
Vehicles may be damaged, inoperable, unsafe, missing parts, or unsuitable for highway use. Buyer assumes all responsibility and risk upon being declared the winning bidder.
4. Titles, Documents, and Title-Related Disclosures
Depending on the vehicle and the legal process used, a vehicle may be sold with one or more of the following:
- clear title;
- salvage title;
- lien-sale documentation;
- court order;
- LT-265 / Record of Sale & Notice of Purchase documentation; or
- no title / parts-only / scrap documentation.
Title Processing & Clerk of Court Delays:
For vehicles requiring lien sale processing, title work, or court-ordered transfer of ownership, the following applies:
- Processing of Reports of Sale, court orders, and title documentation may require additional time after the auction closes.
- Certain transactions require review, approval, or processing by the North Carolina DMV and/or the court system, which are independent agencies not controlled by Ray’s Body Shop & Wrecker Service.
- Processing times are not guaranteed and may vary depending on workload, legal requirements, and agency timelines.
- Delays caused by the DMV, courts, or other governmental entities do not constitute grounds for cancellation, refund, or dispute of the sale.
- Buyer agrees to allow a reasonable processing period and understands that title delivery may take several weeks or longer in some cases.
Important Title Terms:
- Some vehicles may require application to the NCDMV for title issuance or transfer.
- Buyer is solely responsible for titling, registration, taxes, inspection, insurance, and compliance with all NCDMV requirements.
- Ray’s does not guarantee that any vehicle can be titled, registered, inspected, or legally operated on public roads.
- Buyer must independently verify title eligibility and intended use before bidding.
Buyer’s Premium for Title Work:
A $75 buyer’s premium applies only to vehicles for which Ray’s must obtain title-related documentation or complete title work before transfer. If title work is required, buyer must allow additional time for NCDMV or related processing. Court order vehicles and LT-265 vehicles do not carry this $75 buyer’s premium.
5. Buyer Responsibility
By placing a bid, you agree that if you are the winning bidder, you will:
- pay the full purchase amount and all applicable fees within the required time;
- comply with all applicable federal, state, and local laws;
- remove the vehicle within the stated removal period;
- assume all responsibility for transport, loading, storage, titling, and registration; and
- bear all risks of loss, damage, theft, delay, or title complications after the sale.
6. Payment Terms
Payment is due within 24 hours after auction close, unless Ray’s agrees otherwise in writing.
Accepted payment methods:
- Cash
- Company check
- Other forms of payment only if expressly approved by Ray’s in writing
No personal checks accepted.
Failure to timely pay may result in any or all of the following:
- cancellation of the sale;
- forfeiture of bidding privileges;
- resale or reassignment of the vehicle;
- retention of any deposit, if applicable; and
- legal action for damages, costs, fees, and collection expenses to the extent permitted by law.
7. Vehicle Pickup, Storage, and Towing
Purchased vehicles must be removed within 48 to 72 hours, unless otherwise stated by Ray’s in writing.
Additional terms:
- storage charges may apply at $35.00 per day after the allowed removal period;
- buyer must present valid government-issued identification and proof of purchase at pickup;
- buyer is solely responsible for towing, loading, transport, permits, and any third-party carrier arrangements; and
- Ray’s may require an appointment or specific pickup procedures for safety and operational reasons.
8. Inspection and Buyer Due Diligence
Buyers are strongly encouraged to inspect vehicles before bidding. Vehicle descriptions, photos, VIN references, and condition notes are provided for convenience only and are not guaranteed. Failure to inspect does not excuse the buyer from payment obligations or otherwise relieve the buyer of any responsibility under these Terms & Conditions.
9. Bidding Terms
All bids are binding and irrevocable except where prohibited by law.
By bidding, you represent and warrant that:
- you are at least 18 years old;
- you have the legal capacity to enter into a binding contract;
- all registration information you provide is true and accurate; and
- you are not bidding on behalf of another person unless authorized to do so.
Fraudulent bidding, shill bidding, bid manipulation, identity misrepresentation, chargebacks, or auction interference is strictly prohibited. Ray’s is not responsible for website outages, internet delays, software malfunctions, clerical errors, missed bids, delayed bids, or other platform-related issues.
10. No Refunds, No Returns, No Chargebacks
All sales are final.
There will be:
- no refunds;
- no returns;
- no exchanges; and
- no chargebacks.
Any attempted chargeback or payment reversal may be treated as a default and breach of these Terms & Conditions.
11. Liability Waiver
To the fullest extent permitted by law, Ray’s Body Shop & Wrecker Service, its owners, employees, agents, contractors, auction providers, and affiliates shall not be liable for any claim, injury, damage, or loss arising from or related to:
- entry onto or activity at the premises;
- inspection, loading, removal, towing, hauling, or transport of any vehicle;
- mechanical, electrical, cosmetic, structural, safety, title, registration, or documentation issues;
- inaccuracies or omissions in listings, photos, VINs, or descriptions; or
- delays, failures, or disruptions in auction software, internet access, or communications.
12. Default and Legal Enforcement
If a buyer fails to comply with these Terms & Conditions, Ray’s may, to the fullest extent permitted by law:
- cancel the sale;
- revoke bidding privileges;
- retain deposits, if applicable;
- resell the vehicle;
- pursue collection;
- recover damages, court costs, administrative costs, storage charges, towing charges, attorney’s fees where recoverable, and other lawful expenses; and
- report suspected fraud or criminal conduct to law enforcement or appropriate agencies.
13. Indemnification
Buyer agrees to defend, indemnify, and hold harmless Ray’s Body Shop & Wrecker Service and its owners, employees, agents, contractors, successors, and assigns from and against any and all claims, demands, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorney’s fees where recoverable, arising out of or related to:
- the purchase, possession, transport, storage, resale, titling, registration, repair, dismantling, disposal, or use of any purchased vehicle;
- any injury to persons or damage to property involving the vehicle after sale; or
- buyer’s breach of these Terms & Conditions or violation of law.
14. Changes to Terms
Ray’s reserves the right to amend, update, or modify these Terms & Conditions at any time. The version posted at the time of bidding will control that transaction unless otherwise stated.

16. Governing Law and Venue
These Terms & Conditions shall be governed by and construed under the laws of the State of North Carolina. Any dispute arising from or relating to the auction, the sale, or these Terms & Conditions shall be brought in a court of competent jurisdiction in North Carolina, unless applicable law requires otherwise.
Legal Acknowledgment
By registering for, bidding in, or participating in this auction, you acknowledge that you have read, understood, and agreed to these Terms & Conditions, and that all vehicles are sold AS-IS, WHERE-IS under applicable North Carolina law.
